Terms and conditions of use for online identification

Declaration of consent

By clicking on the box "Accept the BANK-now terms and conditions of use," you are confirming that you have read, understood, and therefore agree to the terms and conditions of use for online identification of BANK-now Ltd. (hereinafter "BANK-now"). If you do not accept these terms and conditions of use, do not use the online identification service.

Requirements

An existing client relationship with BANK-now is required to use the BANK-now online identification service. Other persons are not permitted to use this service.
A video-capable device with a high-resolution camera and a microphone is required to ensure audio and image quality that is adequate to perform the online identification process.
The video conversation that is held during the online identification process will be carried out in a language that can be selected on the landing page, provided that you and the service agent speak this language. It is not possible at present to conduct the online identification process in other languages.

Data disclosure and collection

Data disclosure

By completing the data fields and submitting the relevant form, you are starting the process for online identification. The following data must be provided for this purpose:

  • Title
  • First name and last name (as shown on the ID document)
  • Date of birth
  • Nationality
  • Home address/registered office
  • Email address
  • Telephone/mobile number
  • Application number

You are obliged to ensure that the data you provide is accurate and truthful, and you agree to the processing of this data for the specified purposes.

Data collection

When you carry out online identification, BANK-now and Swisscom also collect and process the following data, which you agree to:

  • Data regarding the computer and browser you are using as well as your access to the internet (e.g. type of device, operating system, IP address, access provider)
  • Data about the use of online identification (e.g. login with date and time, accept terms and conditions of use)

Online identification by Swisscom

The online identification process is carried out by Swisscom as a service provider for BANK-now. The online identification process is carried out in the form of a real-time video and audio transmission between you and a Swisscom service agent, and includes in particular:

  • Checking the information contained on the ID document against the data you have entered.
  • Photographs of you and your ID document.
  • Provision of a transaction number (TAN) that is used as a one-time password and must be confirmed by you.

The entire audio transmission takes place in an encrypted format and is recorded. Swisscom is required to process this data on behalf of BANK-now exclusively in the interests of and for the purpose of online identification for BANK-now. It is subject to the same obligations concerning data protection and data security as BANK-now itself and is obliged to keep the data confidential. At the end of the online identification process, Swisscom sends the data to BANK-now and then this data is deleted in full at Swisscom.

Data processing for marketing purposes

BANK-now may use the data collected for marketing purposes and send information about products and services provided by BANK-now or its partners to your mail or email address or to your telephone number (e.g. by text message). You may withdraw this consent to data processing for marketing purposes at any time by sending an appropriately worded letter to BANK-now, Customer Care SBFK 621, P.O. Box 852, CH-8810 Horgen.

Risks of electronic communication

The data is sent via the internet. In addition, for the purposes of online identification, BANK-now may communicate with you by email or text message, e.g. to confirm your identity. Electronic means of communication are generally not secured against access by unauthorized third parties and therefore pose corresponding risks, e.g. insufficient confidentiality, manipulation of content and sender data, misrouting, delays, viruses, etc. BANK-now accepts no liability whatsoever for damages resulting from electronic communication as long as there has been no misconduct on the part of the bank. It acknowledges in particular that neither information relevant to posting nor time-critical information should reach BANK-now via electronic channels.

Fees

The online identification service from BANK-now is currently provided free of charge. When you use the online identification service, you may incur operator fees (e.g. from your internet provider or mobile phone provider) for using the telephone and/or internet connection.

Exclusion of liability

BANK-now cannot guarantee 24/7 fault-free, uninterrupted, and secure access to the online identification process. To the extent permitted by law, neither BANK-now nor any of its individual bodies, employees, or officers bear any liability, even in the event of negligence, for losses or consequential losses incurred from or in connection with the online identification process or its defectiveness or non-availability.

Change to the terms and conditions of use

BANK-now may amend the terms and conditions of use for online identification at any time. Any amendments will be exclusively communicated on the landing page. The current version of the terms and conditions published on the landing page applies to each online identification process.

Place of jurisdiction

The online identification process and the respective terms and conditions of use are governed by substantive Swiss law. The place of jurisdiction is determined in accordance with the statutory provisions.
